Brand ‘looked through me with a blank expression’, claims man

A man said he saw Russell Brand coming out of a toilet at the party followed by a woman and that he ‘looked straight through me with a blank expression’.

In a prepared statement that was read to jurors by the prosecution, the man said he knocked on the toilet door to try to use it.

In the statement, the man said: ‘To my surprise, Russell came out of the toilet and following him out was a woman, I cannot remember her demeanour or how she looked.

‘I said hello to Russell, but he looked straight through me with a blank expression.

‘I introduced myself and said we’d met the previous year. He continued walking away and said something dismissive like “contact my agent”.

‘I found his response quite rude and thought he was acting oddly.’

Woman: ‘I am glad now that I am able to freely talk about it’

The woman added: ‘I did not want people to see me as a victim or to judge me. I have carried it with me. I am glad now that I am able to freely talk about it.’

She has now finished giving evidence.

The court will break for ten minutes.

Woman was ‘scared, shocked and in disbelief’ after alleged rape

The woman said that after the alleged rape, she was ‘scared, shocked and in disbelief’.

She added: ‘It was almost like watching a film of something happening to you.’

The woman said it ‘happened so quickly’, adding: ‘It was just not something you anticipate happening to you… especially just being out for a few drinks.’

She told of feeling ‘like walking around in a daze’.

‘In those days you were not believed as a woman’

The woman began crying while giving evidence.

The prosecutor asked why she did not tell anyone at the time.

The woman told jurors: ‘It felt like my innocence had been taken. I didn’t want to face the reality of what had actually happened to me.’

The woman said the thought of going to the police in 2004 ‘terrified me’.

She added: ‘Just because, in those days, he was a celebrity and it would be his word against mine. I would then be ostracised in my work environment or friends.

‘I just thought the odds weren’t in my favour and I didn’t want to have to go through a court where somebody is tearing down my character.

‘In those days, you just weren’t believed as a woman and it was a lad culture of “you were wearing this, so you were asking for it” and all that rubbish we were told back then.’

She described feeling ‘incensed’ when he was rehired by MTV a few years later.

The tearful woman added: ‘In that situation, you don’t know how you are going to react. It was survival mode.

‘I didn’t know if he would strangle or hit me or anything. You do question yourself later, you question “did I allow that to happen to me?”‘

Woman ‘did not realise alleged attack was classified as rape’

Prosecutor Riel Karmy-Jones KC is now re-examining the woman.

The woman said she did not realise that the alleged attack was classified as rape when it happened.

Ms Karmy-Jones KC asked her: ‘At the time this happened back in 2004, did you consider forced oral sex rape?’

The woman replied: ‘No, to be honest, I didn’t know that was.’

She also said of the alleged attack in the toilets: ‘I was scared, shocked, in disbelief.

‘It was just surreal. I could not believe that had happened. It was a really nice evening, then that happens to you.’

Woman denies being influenced by documentary about Brand

The woman told jurors that she was not ‘influenced’ to report her allegation of rape after seeing a 2023 Dispatches documentary which accused the comedian of sexual misconduct.

Brand’s barrister Ian Winter KC asked: ‘After having watched it and for the first time, including after calling the police, you made an allegation of rape?’

The woman replied: ‘No, it wasn’t that, I wasn’t influenced by that programme.’

Mr Winter asked if what had happened was a ‘bit of a kiss and cuddle’ in ‘very unsatisfactory circumstances’, adding: ‘Certainly no rape.’

The woman replied: ‘No.’

Mr Winter has now finished cross examination of the victim.

Woman ‘did not want to be first person to make allegations’

The woman said she did not want to be the first person to make allegations to the police about the celebrity.

Brand’s barrister Ian Winter KC asked her why she said she had felt ‘shame’ over the incident and the woman replied: ‘That’s the default that women are made to feel.

‘You’re made to feel that it’s your fault because of what you’re wearing or whatever reasons a man thinks he can do things to you against your will.’

Mr Winter asked the woman: ‘You didn’t report it during the MeToo movement when every woman in the world was examining whether she had been sexually assaulted by a famous person?’

The woman replied: ‘I was hoping somebody else would come forward. I didn’t want to be the first person to do that.

‘When you’re one little voice, you’re not sure if you’re going to be heard or believed.’

Brand’s barrister questions woman over what she told police

Mr Winter asked why the woman did not tell the police that she had been raped when she first rang 999 to report the crime in 2023.

The alleged victim said: ‘No, I gave all the details (later) in the statement. I was in a heightened emotional state that weekend when I rang.

‘They did not ask me for the full details. I thought when they come and speak to me, I can tell them everything that happened to me.’

Woman told Brand’s friend he was a ‘sexual predator’, court hears

The woman claimed that she had told a friend of Brand’s ‘you should know your friend is a rapist’.

She added that she also said of Brand: ‘Your friend is a sexual predator.’

Asked about why she was still in the car when it left the venue, the woman said: ‘All I can say is I don’t know why I didn’t just jump out of the car … I can’t say why I was in the car.’

Mr Winter, referring to why the woman eventually left Brand that evening, asked: ‘You realised that you were unlikely to take what had happened further, and you decided to leave for that reason, didn’t you?’

The woman replied: ‘No.’

She said that her ‘mind wasn’t working correctly’ after what had happened.
